1. Acceptance of Terms

By accessing and using the services of VRK Formwork and Concrete Pty Ltd (ABN: 98 652 138 933) ("we", "us", "our", or "VRK"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or website.

2. Services

VRK Formwork & Concrete provides professional concrete and formwork services throughout Perth and Western Australia, including but not limited to:

• Concrete driveways
• Formwork installation (timber and steel)
• Structural concrete
• Decorative concrete
• Commercial concrete projects
• Residential concrete services
• Industrial concrete solutions

3. Quotations and Pricing

3.1 Quotations

• All quotations are valid for 30 days from the date of issue unless otherwise specified
• Quotations are based on information provided by the client and site assessments
• We reserve the right to revise quotations if project specifications change
• Free quotations are provided as a courtesy and do not obligate either party

3.2 Pricing

• All prices are in Australian Dollars (AUD) and include GST unless otherwise stated
• Prices may be subject to change due to unforeseen site conditions, material cost variations, or specification changes
• Additional charges may apply for work outside standard hours or urgent projects

4. Payment Terms

• Payment schedules will be outlined in the project contract
• Typical payment structure: deposit upon contract signing, progress payments during work, and final payment upon completion
• Accepted payment methods include bank transfer, credit card, and cheque
• Late payments may incur interest charges at the rate of 2% per month or the maximum allowed by law
• We reserve the right to suspend work if payments are not received according to the agreed schedule

5. Client Responsibilities

The client agrees to:

• Provide accurate information about the project requirements and site conditions
• Ensure site access is available at agreed times
• Obtain necessary permits and approvals (unless otherwise agreed in writing)
• Provide utilities access (water, electricity) as required
• Remove or protect valuable items in the work area
• Ensure pets are secured during work periods
• Inform us of any underground services or hazards

6. Project Timeline

• Project timelines are estimates and may be affected by weather, material availability, or unforeseen circumstances
• We will make reasonable efforts to complete work within estimated timeframes
• Delays caused by client changes, site conditions, or external factors are not our responsibility
• Extension of time may be granted for delays beyond our control

7. Warranties and Guarantees

7.1 Workmanship Warranty

We provide a warranty on our workmanship for a period specified in your contract (typically 5-10 years depending on the type of work). This warranty covers defects in workmanship under normal use and conditions.

7.2 Materials Warranty

Materials are covered by manufacturer warranties. We will assist in warranty claims where applicable.

7.3 Warranty Exclusions

Warranties do not cover:

• Normal wear and tear
• Damage from misuse, abuse, or neglect
• Damage from extreme weather events or natural disasters
• Issues arising from client modifications or repairs by third parties
• Cosmetic issues such as minor color variations or surface crazing
• Damage from subsidence or movement of underlying soil

8. Variations and Changes

• Any variations to the original scope of work must be requested in writing
• We will provide written quotations for all variation work
• Variation work will only proceed upon written approval and agreement on pricing
• Variations may affect project timelines and will be communicated in advance

9. Cancellation and Termination

9.1 Cancellation by Client

• Clients may cancel before work commences with written notice
• Cancellation fees may apply to cover administration costs and ordered materials
• Once work has commenced, cancellation may result in charges for work completed and materials supplied

9.2 Termination by VRK

We reserve the right to terminate a contract if:

• Payment is not received according to agreed terms
• Site access is not provided as agreed
• Client breaches these terms and conditions
• Unforeseen circumstances make completion impossible or unsafe

10. Liability and Insurance

10.1 Our Insurance

VRK Formwork & Concrete maintains comprehensive public liability insurance and workers' compensation insurance as required by Australian law.

10.2 Limitation of Liability

• Our liability is limited to the contract value of the specific project
• We are not liable for consequential or indirect losses
• We are not responsible for damage to underground services not identified by the client
• Claims must be made in writing within 30 days of discovery

11. Safety and Compliance

• All work is performed in accordance with Australian Standards and Building Codes
• We comply with Work Health and Safety regulations
• Site safety is our priority; clients and visitors must follow safety instructions
• We hold all necessary licenses and certifications for our trade

12. Intellectual Property

All designs, plans, and intellectual property created by VRK Formwork & Concrete remain our property unless otherwise agreed in writing. Clients may not reproduce or distribute our designs without permission.

13. Dispute Resolution

In the event of a dispute, parties agree to:

• First attempt to resolve the matter through good-faith negotiations
• If unresolved, participate in mediation before pursuing legal action
• Disputes will be governed by the laws of Western Australia

14. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Australian Privacy Principles.

15. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government restrictions, strikes, or material shortages.

16. Entire Agreement

These Terms and Conditions, together with any written contract or quotation, constitute the entire agreement between parties and supersede all prior discussions, negotiations, and agreements.

17. Amendments

We reserve the right to amend these Terms and Conditions at any time. Updated terms will be posted on our website with a revised date. Continued use of our services constitutes acceptance of amended terms.

18. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
